Right of Withdrawal
No Right of Withdrawal for Custom-Made Goods
The SeaStorm boats ordered via our configurator are not pre-manufactured but produced in a version individually assembled for you according to the specifications you make during the ordering process (hull colour, upholstery colour, engine, equipment and transport) and are not kept in stock in this composition. They are therefore clearly tailored to your personal needs.
For such goods, there is no right of withdrawal pursuant to § 312g(2) no. 1 BGB. By submitting your order with obligation to pay, you enter into a binding purchase obligation from which you cannot withdraw by way of the statutory right of withdrawal.
We expressly point out this exclusion before completion of the order; you confirm acknowledgement during the order process.
What This Means for You
Please check your configuration carefully before submitting your order. If you have questions about the equipment, the options or the process, we are happy to advise you in advance – by phone at +49 2173 2640400 or by e-mail to [email protected].
Subsequent change requests are only possible by separate arrangement and, where applicable, for additional costs, provided the production status still permits this.
Voluntary Cancellation Right Until Release for Production
Although there is no statutory right of withdrawal for custom-made boats, we voluntarily grant you a free cancellation right: as long as we have not yet released your order for production, you may cancel free of charge. We will inform you by e-mail as soon as production is commissioned; from that point onwards, the order is binding. Any deposit already paid will be refunded in full upon timely cancellation. To cancel, simply send a brief message in text form to [email protected].
Your Statutory Rights in Respect of Defects Remain Unaffected
The exclusion of the right of withdrawal does not affect your statutory rights in the event of defects in the goods (liability for material defects pursuant to §§ 434 et seq. BGB). If the delivered goods are defective, you are entitled to the statutory warranty rights without restriction. Details are set out in our General Terms and Conditions.
